Freelance Policies and Privacy

Please note that while we strive for excellence and success with each of our clients, with the progress of search engine development and changes that have been costly and time consuming to the individual, Arttina cannot and will not guarantee web search engine placement at this point in time.

As a freelance graphic designer, unless a contract has been signed Arttina is not obligated to dismiss or refuse a hire from related/similar services. Each project will be given the same amount of attention and dedication, depending on applicable fees.

All new projects will not commence until a 50% deposit is received.

With a project proposal, the client and not the designer is responsible for additional requests or services previously not agreed upon.

With initial quotes, there is a possibility of additional fees being incurred if the project begins to expand considerably beyond the initial proposal and/or discussion.

All projects are time sensitive and if client has not followed through on said arrangments and has postponed design for any reason, project and said commitments to design are null and void after 12 months. Deposit is non-refundable and any out-standing fees will be due.

Bonus Services and "Free Stuff"

Occasionally we offer additional services at no charge or low cost additional services (normally services that would normally not be overly costly to either the designer nor the client). These offers are at the discretion of the designer and can be revoked at any time. They are normally above and beyond the original quote price and are considered an extra bonus. If the scope of the original project goes beyond the original quote, we reserve the right to no longer fulfill these extra bonuses or can request an additional fee for such bonuses to be decided on by the client with no obligation by said designer.

Maintenance and Hourly Rate

Minor webpage maintenance to regular webpages (not store product pages) over a three-month period, including updating links and making minor changes to a sentence or paragraph on one or two pages can typically be included in the cost. These are minor changes only. It does not including removing nearly all the text from a page and replacing it with new text. If the client or an agent other than Arttina attempts updating the client's pages, time to repair webpages will be assessed at an hourly rate, and is not included as part of the updating time. The three-month maintenance period commences upon final upload of the final pages to the web hosting server.

Changes requested by the client beyond those limits will be billed at the hourly rate of $40.00. This rate shall also govern additional work authorized beyond the maximums specified above for such services as general Internet orientation education, marketing consulting, webpage design, editing, modifying product pages and databases in an online store, and art, photo, graphics services, and helping clients learn how to use their own webpage editor. Please note a large part of an increase in time and costs include additional form creation, php, or any other type of programming.

Changes to Submitted Text

Please send us your final text for any project. Time required to make substantive changes to client-submitted text after the webpages have been constructed will be additional, billed at the hourly rate. We are not responsible for proofing your project unless other arrangements have been decided on previously.

Web Hosting

The client understands that any web hosting services require a separate contract with a web hosting service. The client agrees to select a web hosting service which allows Arttina full access to the website and a cgi-bin directory via FTP.

Assignment of Project

Arttina reserves the right to assign subcontractors to any project to insure the right fit for the job as well as on-time completion.

Legal Stuff

Arttina does not warrant that the functions contained in these webpages or the Internet website will meet the client's requirements or that the operation of the webpages will be uninterrupted or error-free. The entire risk as to the quality and performance of the webpages and website is with client. In no event will Arttina be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the webpages or website, even if Arttina has been advised of the possibility of such damages.

If client has decided during or after the project completion, they are not satisfied or in agreement on final files after much time has been invested, client is still responsible for the costs and hours incurred.

Copyrights and Trademarks

The client represents to Arttina and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Arttina for inclusion in projects are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Arttina and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.

Copyright to the finished assembled projects produced by Arttina are owned by Arttina. Upon final payment of this contract, the client is assigned rights to use as a website the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. Arttina and their subcontractors retain the right to display graphics and other Web design elements as examples of their work in their respective portfolios.
